حماية الرضا في الزواج و منع الإكراه عليه في القانون الدولي

الملخص
للدول ووفق عاداتها التقليدية والدينية، لإقرار ما يناسب من التدابير التشريعية تدرك الدول جميعا أن الواجب تعزيز كيان الأسرة باعتبارها الوحدة الأساسية في كل مجتمع، وأن للبالغين من الذكور والإناث الحق في الزواج وتكوين أسرة، وأن لهم حقوقا متساوية على صعيد الزواج، وأن الزواج لا ينعقد إلا برضا الطرفين المزمع زواجهما رضاء كاملا لا إكراه فيه، غير أن الواقع يشير إلى حالات زواج كثيرة تتم بغير رضا أو تحت الإكراه مما يجعل عقد الزواج في وضع قانوني يسر نحو البطلان في القانون الوطني أو الدولي، وهي حالات تتطلب اتخاذ تدابير لازمة، تشريعية وغير تشريعية، والقيام بالخطوات الضرورية، وفقا للنظام الدستوري أو غيرها لإعمال المبادئ المتعلقة بحماية الرضا وعدم الإكراه في الزواج تطبيقا للقانون الدولي والوطني وحماية لأطراف العلاقة الزوجية All states realize that the duty to reinforce the family entity as the basic unit in every society, and that adult males and females have the right to marry and form a family, and that they have equal rights in terms of marriage, and that marriage does not take place without the full consent of the two parties to whom they are to be married is completely and not coerced.
