مشاركة الجمعيات في حماية البيئة في التشريع الجزائري المعوقات والأدوار

الملخص
تعد مشاركة الجمعيات أحد الآليات الأساسية لحماية البيئة ،وقد اهتم التشريع الجزائري كغيره من التشريعات المقارنة بالنص على دور الفاعل الجمعوي في هذا المجال، بدأ من التعديل الدستوري لسنة 2020،الذي اعترف للمواطن بالحق في البيئة السليمة، ومسؤولية الأشخاص الطبيعية والمعنوية في حمايتها، وكذلك القانون رقم 10-03 المؤرخ في 17 جويلية 2003 المتعلق بحماية البيئة في اطار التنمية المستدامة، الذي نص على عدة أدوار رئيسية للجمعية في هذا الصدد وهي: الدور الاستشاري والتشاوري، الدور التحسيسي والإعلامي، عضوية الهيئات العمومية، وأخيرا الدور القضائي كأداة فعالة لحماية البيئة. غير أن هذه المشاركة ظلت محدودة ودون التوقعات المنتظرة، بالنظر الى جملة من المعوقات التي ساهمت في الحد من فعاليتها ، بدأ من المعوقات القانونية والإدارية، المعوقات المادية والتنظيمية، و المعوقات الاجتماعية والسياسية. ومن ثمة وجب التعرف على هذه الأدوار والوقوف أمام هذه المعوقات من أجل اقتراح حلول ناجعة لتعزيز هذه المشاركة. The participation of associations is considered as one of the essential mechanisms for the protection of the environment, so Algerian legislation, like other similar legislations, has worked to clarify the role of the associative actor in this field, starting with the constitutional revision of 2020, which offered the citizen the right to a healthy environment and the natural and moral responsibility of persons for its protection, as well as Law No. 10-03 of July 17, 2003 relating to the protection of the environment in the context of sustainable development, which stipulated many roles of the association in this sense, namely: the role of advisory and consultation, the role of awareness and information, membership in public organizations, and finally the legal role as an effective instrument in the protection of the environment. However, this participation has remained limited and below expectations, given the number of obstacles that have led to a reduction in its effectiveness, first of all legal and administrative obstacles, financial and organizational obstacles, as well as social and political obstacles. In this regard, it is essential to know these roles and overcome these obstacles in order to propose effective solutions to strengthen this participation.
