محققات التراث النوازلي في الأطاريح الجامعية الجزائرية بين الإشكالات المنهجية واللغة الفقهية المستعصية « الدرر المكنونة في نوازل مازونة أنموذجًا »

الملخص
تعكس هذه الورقة البحثية عمل قاعدة بيانات مُحَوسَبَة لعينة من محققات التراث النوازلي في الأطاريح الجامعية الجزائرية في عرض منهجي، وقراءة مُساءلة لمستويات تجربتها من خلال إبراز ثوابت التحقيق ومزالقه، وانطلاقًا من غموض الظروف والبيئات التي تكونت فيها الرؤى والآفاق للتراث المخطوط بالجزائر عمومًا، والتوجهات العشوائية المتسرعة وغير المترابطة للمشروعات العلمية بالمؤسسات الجامعية خصوصًا، والتي جعلت من مخطوط « الدرر المكنونة في نوازل مازونة » يبحث عن قانون له يحكم عملية التعامل معه، ويحدد الأولويات في إجراء تحقيقه، ثم النظر في نشره تيسيرًا لقارء نصه، فضلاً عن أهميته ذات الارتباط الوثيق بالدرس الأصولي، وما يحتويه من مؤهلات لصناعة العقل الفقهي، وما يتضمنه من فتاوى وتحقيق، يرتقي بها الاجتهاد التطبيقي عند تعامله مع النصوص النوازلية، التي لا ترى نتائجها في الميدان الأكاديمي إلا من خلال تحصيل تلك الدربة في فهم وتأصيل الفقه التنزيلي وإخراجه للواقع بإجابات شافية دقيقة بعيدة عن التنظير والتكرار والإعادة، الأمر الذي يدعوا إلى إعادة رسم الإجراءات المنهجية التي تبين الأطر السليمة للنظر والقراءة في تحقيق نصوصه النوازلية وحل إشكالاتها المستعصية.
