مواصفات الحاكم الشرعي و محددات استحقاقه للطاعة على ضوء القواعد الحاكمة للسياسة الشرعية

الملخص
يتناول البحث جانبا من موضوع السياسة الشرعية و المتمثل في دراسة مواصفات و واجبات الحاكم و الصلاحيات التي كفلها له الإسلام بناء على اعتبارات دقيقة و مختلفة. فطاعة الحاكم حق جعله الله له لكنه متعلق بأهلية و صلاحية المحل له و متعلقة بتلازم علاقة الحق بالواجب و منضبطة بالعقد الرابط بين الحاكم و الجماعة ، فللحاكم حق الطاعة ما التزم بواجباته نحو رعيته و بهذا يفرق جانب التنظير و ما يقابله من التنزيل و الإسقاط على شخص الحاكم حيث أن تولي السلطة تكليف لا تشريف و عبء كبير و أمانة و مسئولية أمام الله و أمام عباده و ليست منصبا دينيا تكون فيه القداسة المطلقة لشخص الرئيس مهما فعل و مهما جار و استحكم . Abstract: The research deals with an aspect of the issue of legitimate politics, which is the study of the specifications and duties of the ruler and the powers that Islam guaranteed to him based on accurate and different considerations. Obedience to the ruler is a right that God has made for him, but it is related to the eligibility and validity of the place for him, and it is related to the inseparability of the relationship of the right to the duty, and it is regulated by the contract linking the ruler and the group. And the fall on the person of the ruler, since assuming power is a mandate, not an honor, a great burden, a trust, and a responsibility before God and his servants, and it is not a religious position in which the absolute sanctity of the person of the president, no matter what he does, and no matter how persistent and persistent.
