مدى فعالية الحق في بيئة سليمة في إرساء معالم أهم حقوق الإنسان الأساسية

الملخص
ملخص: ولد الحق في بيئة سليمة كحق بشريّ حديثا، مع انتصاف القرن الماضي، غير أنّه وجد كيانه وفرض نفسه بطريقة سريعة جدّا، جعلت منه حقا عملاقا، وذلك من خلال التّداخل والتّرابط الموضوعي الذي يربطه بغيره من حقوق الإنسان الأخرى، سواء كانت فردية أو جماعية، حيث تهدف هذه الدّراسة إلى تحليل محتوى ومضمون هذا التّرابط الموضوعي، وإبراز مدى الحاجة الماسة لبعض هذه الحقوق للحق في بيئة سليمة، من أجل تجسيدها وتكريسها ميدانيّا بطريقة مثالية. بينما سيتمّ الاحتكام في ختام هذه الورقة البحثية إلى نتائج حتمية مفادها أنّ الحق في بيئة سليمة أصبح يحتلّ مكانة قانونية مرموقة في خضمّ التّرسانة الهائلة لحقوق الإنسان المعترف بها عالميّا، حيث لا يمكن لهذه التّرسانة التّنازل عن الرّابطة المتينة التي تجمعها مع الحق البيئي، ممّا جعل أغلب دساتير العالم تتسابق نحو دسترته، وإدراجه كبعد دستوريّ في مضمون نصوصها. The right was born in a healthy environment as a modern human right, with the midst of the last century, but it found its entity and imposed itself in a very rapid way, which made it a gigantic right, through the overlap and the objective interconnection that links it with other human rights, whether individual or collective, where This study aims to analyze the content and content of this thematic correlation, and highlight the urgent need for some of these rights for the right to a healthy environment, in order to embody and devote them in the field in an ideal way. While at the conclusion of this research paper will be invoked the inevitable conclusions that the right to a healthy environment has come to occupy a high legal position in the midst of the vast arsenal of internationally recognized human rights. The constitutions of the world are racing towards constitutionality, and its inclusion as a constitutional dimension in the content of their texts.
