الارهاب المعلوماتي في ضوء قانون العقوبات الجزائري

الملخص
مكن التطور في تكنولوجيا الإعلام والاتصال المجرم من تحقيق أهداف كثيرة ذات دقة عالية في وقت قياسي وداخل دائرة آمنة لا يترك فيها أي دليل، ومن أخطر هذه الأفعال الإجرامية الإرهاب المعلوماتي الذي يقصد من خلاله أولا الإرهاب باستعمال تكنولوجيا الإعلام والاتصال من مشاركة وتحريض ودعم لجهات معينة تعمل في هذا الإطار سواء كان الإرهاب موجها داخليا أو خارجيا، وثانيا الإرهاب الذي يظهر في الاعتداء على المعلومة في العالم الافتراضي بما يخلق آثار الإرهاب المادي في أرض الواقع مهما كانت الجهة المستهدفة، هذه الوضعية دفعت المشرع الجزائري إلى وضع نصوص خاصة في محاولة منه تحقيق مواجهة فعالة، وهو الأمر الذي سنتناوله بالدراسة الحالية من منطلق البحث في تحقيق هذه الفعالية من عدمها. The development of information technology has enabled the criminal to achieve many objectives and with high accuracy in record time and within a secure circle in which no evidence is left, one of the most dangerous of these criminal acts is information terrorism, through which terrorism is first intended to use information and communication technology from the participation terrorism, through which terrorism is first intended to use information and communication technology from the participation and incitement, support for specific actors working in this framework whether terrorism e-court internally or externally, and secondly terror that appears in the attack on the information in the virtual world creating physical effects of terrorism in the ground no matter what the target audience, This situation that pushed the Algerian legislator to drafts special texts in an attempt to achieve an effective confrontation, and this is what we are dealing with in the current study in order to look into achieving this effectiveness or not.
