الملخص
تتميز القوانين العضوية كنوع من انواع التشريع بأهمية خاصة ضمن الاحكام الدستورية، وذلك يعود بصفة خاصة إلى الرقابة التي تخضع إليها قبل صدورها، كون أن القوانين العضوية تتضمن مواضيع ذات صبغة دستورية، وفي حمايتها يتحقق مبدأ سمو الدستور، ويختص المجلس الدستوري بعملية الرقابة التي تخضع لها القوانين العضوية، عبر كل مراحل سنها فبالتالي يعتبر المجلس الدستوري شريك أساسي في إعداد القوانين العضوية، وهذا البحث يعتبر تأكيد لهذه الخصوصية التي تضمنتها القوانين العضوية ضمن الأحكام الدستورية. Basic laws as a type of legislation are distinguished by a special importance within constitutional provisions, and this is due in particular to the oversight they are subject to before their issuance, since the basic laws contain issues of a constitutional nature, and in their protection the principle of the supremacy of the constitution is fulfilled, and the Constitutional Council is concerned with the process of oversight to which it is subject Basic laws, through all stages of their enactment, therefore the Constitutional Council is considered a fundamental partner in preparing basic laws, and this research is an affirmation of this specificity contained in the basic laws within the constitutional provisions.
