التوظيف المقاصدي للهدي النبوي بفهم الجزئيات في ضوء الكليات

الملخص
تُعتبر قاعدة رد الجزئيات إلى الكليات رافدا مهما من روافد تقصيدِ الهدي النبوي؛ قولًا أو فعلًا أو تقريرًا، حيث إنها تُسهم في إبراز جمالية الشريعة الإسلامية وحسنها وبهجتها عموما، والسنة النبوية خصوصا، في صورة انتظام أحكامها ونصوصها كلها متناسقة على نظام واحد. ويدرء توهم التعارض والتناقض عنها. ويضيق فجوة الخلاف بين الدارسين للشريعة عموما وللسنة النبوية خصوصا. وقد قام أساس رد الجزئي للكلي على الجمع بين النصوص، إما بتأويل معتبر أو باختلاف حال أو عرف أو شخص .... على صورة تجعله يتوافق ويتلاءم مع المصلحة القطعية المعتبرة شرعًا. ولا يُقصد بهذا المسلك إقصاء النصوص النبوية الجزئية والإعراض عنها والطعن فيها، إنما القصد بأن لا تُفسَّر هذه النصوص الجزئية ولا تُفهم بمعزل عن المقاصد الكلية. The rule of returning parts to public colleges is an important tributary of the pursuit of the Prophet’s guidance. The basis of the partial response to the general college is based on combining texts either with a significant interpretation or by different status, custom or person ... in a way that makes it compatible and compatible with the definitive interest that is legally recognized. This approach is not intended to exclude partial prophetic texts, to turn away from them, and to challenge them.
