إعمال المقاصد في السنة النبوية: أصالة شرعية وضرورة عصرية

الملخص
ملخص السنة النبوية الشريفة هي المصدر الثاني من مصادر الشريعة الإسلامية، وهي مع القرآن الكريم معين لا ينضب لمختلف الأحكام التشريعية التي تحقق للناس مصالحهم في الحال والمآل، إلا أنه من هذه الأحكام ما هو ظني في دلالته، مما يحتاج إلى الاجتهاد وإعمال العقل والفكر لاستنباط ما يتناسب مع تجسيد مقاصد الشريعة التي هي مقاصد لحفظ حياة الناس. وإذا كانت السنة النبوية هي التطبيق العملي للقرآن الكريم، فهي مجال خصب للفهم المقاصدي لأحكام الشريعة، والتي تحتاج إلى إبرازها من قبل العلماء والباحثين؛ إذ الفهم المقاصدي في السنة النبوية، أصيل أصالة هذا المصدر التشريعي، من خلال أفعال النبي صلى الله عليه وسلم وأقواله، كما تظهره العديد من الأحاديث النبوية الشريفة. ومع تطور الحياة وتشعبها في عصرنا المعاصر، وجب إعمال الفهم المقاصدي للسنة النبوية الشريفة، من دون إفراط ولا تفريط؛ للوصول إلى فهم الشريعة الإسلامية وترجمة أحكامها في أرض الواقع بما يتماشى مع مستجدات العصر، وبما يثبت اتّصاف هذه الشريعة الغرّاء بالمرونة والثبات، وهو مظهر من مظاهر إعجاز الدين الإسلامي، وأنّه صالح لكل زمان ومكان. كلمات مفتاحية: السنة النبوية – المقاصد – الفهم المقاصدي - الاستنباط - أحكام الشريعة Abstract The noble Prophet’s Sunnah is the second source of Islamic law, and it is, along with the Holy Qur’an, a source for various legislative provisions that preserve people’s equilibrium in the immediate and final situation. However, there are some of these rulings that are thought to be of significance, which requires diligence and the work of reason and thought to devise what is commensurate with the realization of the Maqasid of the Sharia, which are the purposes of preserving people's lives. If the Prophet’s Sunnah is the practical application of the Holy Qur’an, then it is a broad field for the Maqasid understanding of the rulings of Sharia, which needs to be demonstrated by scholars and researchers. As the understanding of the purposes of the Prophet's Sunnah is the authenticity of this legislative source, through the actions and sayings of the Prophet, may God bless him and grant him peace, as shown by many of the noble hadiths. With the development of life in our contemporary era, it is imperative to implement the objective understanding of the noble Prophet’s Sunnah, in order to reach an understanding of Islamic law and apply its rulings in reality in line with the developments of the age, and in a manner that proves that this Sharia is flexible and steadfast, which is a manifestation of the miracle of the Islamic religion, and that it is valid for all times and place.
