تذليل العقبات الشرعية لإنعاش التبرّع بالأعضاء في الجزائر مع تعليق على قانون الصحة الجديد

الملخص
الملخص: رغم تطوّر الجراحة في حقل " زراعة الأعضاء"، ورغم الرأي الشرعي السائد في جوازه لا يزال واقعه في المجتمعات المسلمة مشلولا، مما سبّب استمرار معاناةُ المرضى وعثر مجهودات الدول في معالجتهم، وخاصة مرضى القصور الكلويّ المزمن. ويعزي المتابعون أهم أسباب هذا الشلل إلى ركن "المتبرِّع"، والذي يُعزى بنفسه إلى معوّقات أهمُّها الجانب الشرعيّ، بشِقّيه العلمي والتوعَوي. وقد عُني المقال بالجانب الشرعي العلميّ، أي الإشكالات العالقة في مشروعية التبرع بالأعضاء ونقلها، من خلال تفنيد أهم المستندات الشرعية للمنع. مع التعريج على مضمون قانون الصحة الجديد (18/11) الصادر في 2018م، للتعليق على الموادّ المنظمة للتبرع بالأعضاء ضمن فصل "البيو-أخلاقيات" منه، مساهمة وسعيا في تذليل العقبات في طريق هدا الإحسان، والله ولي التوفيق. Abstract: For now and despite the development of surgery in "organ transplantation" field , and despite the prevailing legal opinion on its permissibility of medication generally , Its reality in Muslim societies remains paralyzed, which has caused patients continued suffering and hampered states efforts to treat them ,especially patients with chronic renal insufficiency. The followers attribute this paralysis to the main reasons related to the donor, Which is due to the most important of which : legal convictions and lack of awareness of this section of charity . This article concerns the refutation of the legal problems pending in the legality of organ donation and transfer, by refuting the main Legal documents for objectors , with the review of the new health law content (11/18) issued in 2018 , To comment the organizing organ donation articles within its “Bio-Ethics” chapter , a contribution and pursuit to overcome obstacles in the way of this benevolence, and ALLAH grants success.
