الطبيعة القانونية لعقود إستكشاف وإستغلال المحروقات قراءة تحليلة على ضوء قانون المحروقات رقم:13/19.

الملخص
تعد عقود استكشاف واستغلال المحروقات الأداة القانونية لاستغلال الثروات البترولية والغازية، وهي أهم العقود التي تبرمها الدولة، فهي تختلف عن العقود الاخرى في المواد المدنية والتجارية، لكون الاطراف المتعاقدة فيها ينتمون لأنظمة قانونية مختلفة، ، وهو ما يثير مسألة التكييف القانوني لهذا النوع العقود، حيث تحرص الدولة المتعاقدة على إخضاع هذه العلاقة التعاقدية الى قانونها الداخلي، على أساس مبدأي الملكية والسيادة، وفي المقابل تعتبر الشركات الاجنبية أن العلاقة التعاقدية قائمة على مبدأ المساواة في التعاقد، لذلك تسعى إلى اخضاعها الى القانون الدولي العام، ومن خلال هذه الورقة البحثية التي حاولنا فيها تحديد الطبيعة القانونية لعقود استكشاف واستغلال المحروقات، إنطلاقا من تحديد مفهومها، وعرض وتحليل أهم الاتجاهات الفقهية، التي تناولت التكييف القانوني لها، لنصل في النهاية إلى الإتجاه الذي تبناه المشرع الجزائري في تكييف هذه العقود، في القانون رقم 19/13 المتعلق بالمحروقات. The contracts for exploration and exploitation of hydrocarbons are the legal tools for the exploitation of petroleum and gas resources, they are the most important contracts concluded by the state, as they differ from other contracts in civil and commercial matters because the contracting parties belong to different legal regimes, which raises the issue of the legal adaptation of these type of contracts, where The contracting state focusing on the contractual relationship to its internal law, on the basis of the two principles of ownership and sovereignty, and in return foreign companies consider that the contractual relationship is based on the principle of equality in contracting, so they seek to subordinate them to general international law, and through this research paper that we tried. the legal nature of contracts for exploration and exploitation of hydrocarbons is based on defining their concept, presenting and analyzing the most important jurisprudential trends that dealt with their legal adaptation, to conclude the direction adopted by the Algerian legislator in adapting these contracts, in Law No° 19/13 related to hydrocarbons
