دراسات التأثير : آلية لإدماج البعد البيئي في المشاريع الاستثمارية

الملخص
لقد عملت الدولة الجزائرية على تشجيع الاستثمار بشقيه الوطني والأجنبي، مما فسح المجال نحو تحقيق العديد من الاستثمارات كالبحث والتنقيب واستخراج المحروقات واستغلال المناجم، بالموازاة ساهمت هذه الاستثمارات بشكل خطير في تلويث البيئة. فأصبحت الجزائر أمام واقع يفرض عليها مراجعة منظومتها القانونية المتعلقة بالاستثمار، بما يتوافق مع مقتضيات التنمية المستدامة التي كرسها إعلان ريو 1992 والتي تقوم أساسا على إدراج البعد البيئي في أي نشاط اقتصادي، فأقر المُشَرِّع الجزائري مبدأ حرية الاستثمار في إطار حماية البيئة. تعد دراسة التأثير من أهم الآليات القانونية التي تستجيب للمتطلبات الحديثة لمبدأ الوقاية والحيطة، باعتباره إجراء مسبق يبين من خلاله المستثمر التدابير التي سيتخذها لمنع ظهور التلوث أو التخفيف من آثاره أو مكافحة أضراره إذا ظهرت، فهو وسيلة للوقوف أمام المشاريع الاستثمارية التي تضر بالبيئة. The Algerian state has worked to encourage investment, both nationally and internationally, which has given way to many investments such as research, exploration, fuel extraction and mining. In parallel, these investments have contributed seriously into polluting the environment. So, Algeria became faced with a reality that requires it to review its legal system related to investment, in line with the requirements of sustainable development enshrined in the 1992 Rio Declaration, which are mainly based on the inclusion of the environmental dimension in any economic activity, which lead the Algerian legislator to approving the principle of freedom of investment in the framework of environmental protection. The study of impact is one of the most important legal mechanisms that respond to the modern requirements of the principle of prevention and precaution, as it is a precautionary measure through which the investor shows the measures that he will take to prevent the emergence of pollution, reduce its effects or combat its damage if it appears, as it’s a way to stand in front of investment projects that harm the environment.
