الملخص

This research deals with the role of the judiciary maintaining family ties through two topics: custody and the right to visit, and the role of the judge in balancing the legal texts and seeking the interest of the conmen to decide what he deems appropriate when assigning custody. The issue of the right to visit, in turn, raises several problems, both in the legal texts and in relation to disputes concerning it, and the discretion of the judge in resolving these problems in order to preserve familly ties يتناول هذا البحث دور القضاء في الحفاظ على الروابط الأسرية من خلال موضوعين وهما إسناد الحضانة وحق الزيارة والإشكالات المتعلقة بهما، ودور القاضي هنا يتمثل في الموازنة بين ما سطرته النصوص القانونية والبحث عن مصلحة المحضون لتقرير ما يراه مناسبا عند إسناد الحضانة. كما أن موضوع حق الزيارة يطرح إشكالات عدة سواء في النصوص القانونية أو فيما يتعلق بالمنازعات المتعلقة به، والسلطة التقديرية تكون للقاضي في حل هذه الإشكالات حفاظا على الروابط الأسرية.
