التخطيط كوسيلة لتسيير العقار الحضري Planning As A Means Of Managing Urban Real Estate

الملخص

إنّ مهمة التعمير هي بدون شك تحسين الشكل العمراني، ولما كانت المسألة العقارية تطرح تخطيط وتنظيم مسبق للمجال الحضري العقاري، فإن قانون التعمير يلعب دورا في تسيير المحفظة العقارية وهذا من أجل بلوغ شروط نوعية ولأجل خلق مدن ذات معايير عالمية تتوفر على جل الإمكانات و الوسائل العامة، وبالتالي يعتبر العقار والتعمير وجهان لعملة واحدة فالعقار يحدد الإطار المادي أما قانون التعمير يحدد الإطار القانون والتنظيمي له، فهو يهدف إلى تحديد القواعد العامة من أجل تنظيم الأراضي القابلة للتعمير وهذا من أجل التوازن ما بين وظيفة السكن والفلاحة والصناعة وأيضا وقاية المحيط والأوساط الطبيعية والمناظر والتراث الثقافي والتاريخي على أساس احترام مبادئ وأهداف السياسية الوطنية للتهيئة العمرانية فالتخطيط وسيلة لتسير العقار فتستعملها الدولة في إنتاج وهيكلة المجال الحضري وذلك بفتح مناطق جديدة للتعمير وتزويدها بمختلف التجهيزات والمرافق الضرورية The task of reconstruction is undoubtedly the improvement of the urban form, and since the real estate issue raises planning and prior organization of the urban real estate field, the reconstruction law plays a role in the management of the real estate portfolio and this is in order to achieve specific conditions and in order to create cities with international standards that have most of the public capabilities and means Therefore, real estate and construction are considered two sides of the same coin. Real estate defines the physical framework. As for the reconstruction law, it defines the legal and regulatory framework for it Agriculture and industry, as well as protecting the environment, natural surroundings, landscapes, and cultural and historical heritage on the basis of respecting the principles and objectives of the national policy for urban preparation. Planning is a means for real estate management, so the state uses it in the production and structuring of the urban sphere by opening new areas for reconstruction and providing them with various necessary equipment and facilities.
