الملخص

إن عدم التزام الشركات عبر الوطنية بقواعد المسؤولية الدولية، هو ارتكابها لتصرفات وأفعال يحظرها القانون الدولي العام، ويوقع على مرتكيبها الجزاء، ومن هذه الجرائم ما يتعلق بالبيئة، وأن قواعد المسؤولية الدولية عموما ما زال ينتابها بعض الغموض خاصة في المجال البيئي، والسبب في ذلك هو أن الالتزامات الدولية خاصة تلك التي أوجدها العرف ومبادئ القانون العامة ما زالت غامضة، وطالما أن الشركات عبر الوطنية أصبحت تتبوأ في ظل العولمة مركزا قانونيا متميزا، وأضحت تمتلك مقومات التمتع بالشخصية القانونية الدولية، فان رفع دعوى المسؤولية الدولية تجاه الشركات عبر الوطنية عن الأضرار البيئية أمرًا لا مناص منه على أساس عولمة المسؤولية الدولية للشركات. Abstract: The non-commitment of transnational corporations with the rules of international responsibility, is their commission of acts prohibited by public international law, and those who committed such prohibited acts will be punished. These include crimes concerns the environment, and the rules of international liability in general remained ambiguous, particularly in the environmental field, and the reason for this; that international obligations, especially those created by custom and general principles of law are still ambiguous ; As transnational corporations, particularly under globalization, enjoyed a privileged international legal status, and they have the potential to enjoy international legal personality, Therefore; the prosecution of international liability to transnational corporations for environmental damage is inevitable on the basis of globalization of corporate international responsibility.
