الملخص
يتناول البحث بالدراسة والبيان أحد أهم الأنظمة المستحدثة لوقاية البيئة من التأثيرات السلبية للمنشآت المصنفة في الجزائر، بالنظر لما تشكله هذه الأخيرة من أخطار معتبرة على البيئة، والإنسان، وبصفة عامة على المجال الحيوي الذي تعيش فيه مختلف الكائنات الحية. لقد أدّى التلوث والاستنزاف الخطير للثروات الطبيعية الناجم عن استغلال المنشآت المصنفة إلى دق ناقوس الخطر، والدعوة إلى ضرورة التدخل للحد من هذه المخاطر، والعمل على تنظيم هذا النوع من المنشآت بما يضمن مراعاة الأبعاد البيئية من جهة، وتحقيق التنمية المستدامة من جهة أخرى، وهو الأمر الذي جاءت لتحقيقه مختلف الدراسات التقنية المتعلقة بالبيئة على غرار نظام دراسة التأثير البيئي. تأتي هذه الدراسة انطلاقا من آخر التعديلات التي تضمنها المرسوم التنفيذي 18 – 255 المؤرخ في 9 أكتوبر 2018 يعدل ويتمم المرسوم التنفيذي 07 – 145 الذي يحدّد مجال تطبيق ومحتوى وكيفيات المصادقة على دراسة وموجز التأثير على البيئة، والذي يرتكز بدوره على قانون حماية البيئة في إطار التنمية المستدامة 03 – 10. The research deals with the study and the statement of one of the most important systems developed to protect the environment from the negative effects of the classified structures that pose significant dangers to humans, animals and plants, and in general the vital field in which human lives. Pollution and the great depletion of the natural resources resulting from the exploitation of the classified installations have led to the alarm , the call for need to intervene to reduce these risks , and to work on organizing this type of facilities in order to ensure respect for the environmental dimensions on the one hand ,and realize durable development on the other hand ; which is the result of various technical studies related to the environment similar to the environmental impact study. This study comes from the latest amendments included in the Executive Decree 18-255 of October 9, 2018 amending and completing the Executive Decree 07 - 145 which defines the scope of application, content and modalities for approving a study and summary of the impact on the environment, which in turn is based on the Environmental Protection Law in the context of development 03/10.
