عقد التوريد وأثره التحوطي في المصارف الإسلامية

الملخص
يتعلق هذا البحث بعقد التوريد وأثره التحوطي في المصارف الإسلامية، حيث انطلقنا في بحثنا بمقدمة تم من خلالها التعريف بالبحث وبيان أهميته وأهدافه والدراسات السابقة والخطة العامة في ذلك، ثم بعدها انتقلنا إلى بيان حقيقة المصطلحات المتمثلة في عقد التوريد، ثم ثنينا بحثنا هذا ببيان مشروعية عقد التوريد الذي يعد من العقود المعاصرة التي لم يرد نصّ صريح عليها ومن ثّم فقد قام الفقهاء بوضع تكييف فقهي لها وإدراجها حول المسألة الخلافية القائمة على هل الأصل في العقود المستحدثة الصحة والجواز؟ أم الأصل فيها التحريم والبطلان؟، إلى أن وصلنا ثالثا إلى الأثر التحوطي لعقد التوريد في المصارف الإسلامية، وذلك من خلال بيان طرقه وأهم المخاطر التي تواجه صيغة عقد التوريد بالإضافة كذلك إلى الآثار التحوطية منه، ثم في الأخير خاتمة تبين أهم النتائج والتوصيات المتوصل إليها، مع تذيل ذلك بقائمة المصادر والمراجع . This research relates to the supply contract and its hedging effect in Islamic banks, where we set out in our research with an introduction through which the research was introduced and clarified its importance and objectives and the general plan in that, then we moved on to clarify the truth of the terms represented in the supply contract, then we praised this research with a statement of the legitimacy of the supply contract It is one of the contemporary contracts for which no explicit text is stipulated, and then the jurists have developed a juristic conditioning for it and included it on the contentious issue based on: Is the origin in the contracts that were developed is valid and permissible? Or the principle in which the prohibition and invalidity? Until we reached a third of the precautionary effect of the supply contract in Islamic banks, by showing the ways and the most important risks facing the formula of the supply contract in addition to the precautionary methods from it, then finally, a conclusion showing the most important results and recommendations reached, with an appendix to this list of sources and references.
