الملخص
دور الردع القانوني في الوقاية من حوادث المرور الملخص: عرفت حوادث المرور ارتفاعا رهيبا في الآونة الأخيرة حتى أصبحت تسمى بإرهاب الطرقات، وهي تشكل خطر على المجتمع و أفراده لما تخلفه من خســائر مـــادية و بشرية تتكبدها الأسرة و المجتمع و الدولة على حد السواء. وتكاثف الجهود للحد من هذه الظاهرة مسؤولية الجميع انطلاقا من الأسرة وكل الفاعلين الاجتماعيين ولعلّ أسلوب الردع الذي يوجب الالتزام بالقواعد المرورية احد هذه الطرق التي تضع حد للمخالفات المرتكبة ، و القضاء على كل ما يعترض تسهيل حركة المرور وفرض عقوبات صارمة على كل من يخالف القوانين المنصوص عليها. انصب اختياري لهذا العنصر لما له من وزن على التقليل من حوادث الطرقات فالمواطن قد يرمي كل الأمور عرض الحائط لكن عندما يتعلق الأمر بالعقوبة يضع لها اعتبار ويحرص على تجنبها. ---------------------------------------------------- Résume: Le rôle de la dissuasion juridique dans la prévention routière Les accidents de la route ont pris récemment une ampleur dramatique au point de mériter le qualificatif de 'terrorisme routier', au vu de ce qu'elle engendre comme dégâts humains et matériels subit par la famille, la société et l'état. Il est alors de la responsabilité de tous, depuis la famille jusqu'aux acteurs sociaux, d'œuvrer conjointement à la réduction de ce phénomène. Et à cet égard, la dissuasion qui impose le strict respect du code de la route constitue un des moyens pour lutter contre les infractions commises, réduire les obstacles au flux de la circulation et sanctionner sévèrement les contrevenants. Mon choix a été motivé par l'importance que revêt la sanction dans la réduction des accidents de la route. Sachant que l'usager de la route tient compte des sanctions plus que de tout autre élément. ........................................................................... Abstract: The role of Legal deterrents in the prevention of road accidents Road accident have recently witnessed a dramatic rise to such an extent that it bears deservedly the name of 'road terrorism' with regard to the human and material losses they cause to families, communities and states. It is therefore the duty of everyone, starting from families to all social actors to join their efforts in reducing this phenomenon. And in this respect, legal deterrence as a means of enforcing laws constitute a way of fighting road offenses, reducing obstacles to road traffic and imposing severe sanctions to offenders. My choice was motivated by the fact that this element is important in preventing road accidents, given that, road user stake into more than anything else.
