الملخص
تهدف هذه الدراسة للوقوف على الإستراتجية الوطنية للهجرة واللجوء في كل من الجزائر والمغرب، وخاصة ما يتعلق بقطاع الشغل، فللدولة سلطة وضع القواعد المتعلقة بدخول العمال الأجانب إلى إقليمها وإقامتهم على هذا الإقليم بقصد العمل، وكذلك القواعد المتعلقة بولوجهم سوق العمل الوطني، وتحديد الشروط التي يتعين عليهم استيفائها، والضوابط التي يتحتم عليهم مراعاتها والتقيد بها حتى يتسنى لهم مزاولة العمل على إقليم الدولة بطريقة قانونية. وعليه؛ فقد تطرقت هذه الدراسة لإبراز أحد أهم مجالات تطبيق الإندماج الإجتماعي في القانونين الجزائري والمغربي من خلال ادماج الأجانب وفقاً لقيود وضوابط قانونية لممارسة العمل سواء تلك الواردة في القواعد العامة كقانون رقم: 81-10 و08-11 بالنسبة للمشرع الجزائري، أو قانون الشغل رقم: 99-65، أو المنصوص عليها في الأحكام الخاصة كالقانون رقم: 12-19، بالنسبة للمشرع المغربي. This study aims to find out the national strategy for migration and asylum in Algeria and Morocco, especially with regard to the labor sector. The state has the authority to set rules relating to the entry of foreign workers into its territory and their residence in this region with the intention of work, as well as the rules relating to their entry into the national labor market, and to define the conditions that must be They must fulfill them, and the controls that they must observe and adhere to in order for them to legally conduct work on the state's territory. Accordingly; This study deals with highlighting one of the most important areas of applying social integration in the Algerian and Moroccan laws through the integration of foreigners according to the legal restrictions and controls for practicing work, whether those mentioned in the general rules such as Law No. 81-10 and 08-11 for the Algerian legislator, or the Labor Law No. 99 -65, or stipulated in special provisions such as Law No. 12-19, for the Moroccan legislator.
