إستنزاف الاراضي الفلاحية في الجزائر

الملخص
ملخص : إن الحماية والحفاظ على الأراضي الفلاحية تشكل أولوية لكل سياسة تهدف إلى ترقية وتنمية الانتاج الفلاحي لأن العصر الذي نعيشه اليوم لم يعد قاصرا على الدول مالكة السلاح، بل هي الدول القادرة على تحقيق الأمن الغذائي القومي،وبذلك كل عملية اقتطاع لأرض فلاحية لغاية التعمير والتصنيع يجب أن تخضع لقواعد صارمة كونها ثروة طبيعية غير قابلة للتجديد لا يمكن الاستغناء عنها، ومرتبطة بحياة الناس ومصلحة المجتمع. لذلك يجب على السلطات العمومية أن تولي أهمية لهذا القطاع من خلال إرساء الأمن القانوني لتدعيم الصلة بين الفلاح وأرضه ، وتفادي إصدار التعليمات التي أضحت تنافس التشريع وأصبحت مصدر للاعتداء على الاراضي الفلاحية، وتفعيل الجهاز الرقابي ، دون إهمال لجوء المشرّع الى النصوص الجنائية لتجريم أي فعل يمس النظام الاقتصادي في مجال الاراضي الزراعية ويُعاقب الجاني بالعقوبة الرادعة . الكلمات المفتاحية :الأراضي الفلاحية – التجزئة – التجميع – حق الشفعة – الحماية الدستورية . تصنيف JEL :Q1-Q3 Abstract: Protecting and preserving agricultural lands is a priority for every policy that aims at promoting and developing the agricultural production , this is not the case of only states owning weapons, but also countries that are able to achieve national food security .thus , every process of truncation of agricultural lands for reconstruction and industrialization has to be subject to strict rules as being an indispensible natural wealth that is linked to people’s lives and society interests. Therefore, the public authorities should attach importance to this sector by establishing legal security to strengthen the link between the present and his land , to avoid issuing instructions that compete legislation and become a source of assault on agricultural lands,and activating the regulatory system , without neglecting criminal provision to deal with any act that effect the economic system in the field of agricultural land , and punishes the offender with a severe punishment
