انعكاسات علاقة مجلس الأمن بالمحكمة الجنائية الدولية بين التقييد والتفعيل

الملخص
ملخص: ترتبط المحكمة الجنائية الدولية بعلاقة قانونية تجاه مجلس الأمن بموجب نظامها الأساسي، وهذه العلاقة تنتج أثاراً وانعكاسات قانونية، فبعضها قد يكون له انعكاسات ايجابية على المحكمة، واغلبها لها انعكاسات سلبية عليها نتيجة التوجهات السياسية للمجلس. فعلاقة المحكمة الجنائية الدولية بمجلس الأمن يحكمها وجهان اثنان:الأول وجه ايجابي يتمثل في تفعيل نشاط عمل المحكمة الجنائية، وهذه الايجابية تظهر عندما يقوم مجلس الأمن بإصدار قرارات تحفز المحكمة على ممارسة اختصاصها القضائي ويتركها تمارس صلاحياتها بكل حرية بل ويساندها في عملها. أما الثاني فهو وجه سلبي يتمثل في تقييد مجلس الأمن للمحكمة وتعطيلها عن ممارسة اختصاصاتها المكلفة بها، ويتحقق ذلك عندما يصدر قرارات ضد اختصاصات المحكمة تتعلق بإرجاء التحقيق أو المقاضاة في قضية معروضة أمامها، أو عدم التفاته لتقرير حالة من حالات العدوان، مما يعد تدخلاً في اختصاصاتها وتقييد حريتها وتضييق الخناق عليها وتبقى مكتوفة الأيدي حيال هذا الوضع. Abstract:The International Criminal Court has a legal relationship with the Security Council under its statute, and this relationship produces legal implications and repercussions, some of which may have positive repercussions on the court, and most of them have negative repercussions on them as a result of the council's political orientations. The relationship of the International Criminal Court with the Security Council is governed by two aspects: The first is a positive aspect, which is to activate the activity of the criminal court, and this positive appears when the Security Council issues decisions that motivate the court to exercise its jurisdiction and leave it to exercise its powers freely and even support it in its work. As for the second, it is a negative aspect, which is the restriction by the Security Council of the court and its obstruction from the exercise of its competences entrusted to it. And restricting her freedom and tightening the noose on her, and she remains idle about this situation.
