الرقابة البرلمانية على أعمال الحكومة من خلال آلية ملتمس الرقابة

الملخص
ملخص: إن مظاهر الرقابة التي تباشرها السلطة التشريعية في مواجهة السلطة التنفيذية كثيرة ومتعددة، لكن ممارستها باستخدام آلية ملتمس الرقابة يعتبر من أهمها على الإطلاق، ذلك أن توظيف النواب لهذه الآلية ونجاحهم في تخطي شروطها وإجراءاتها يؤدي إلى تحريك المسؤولية السياسية للحكومة. من جاءت هذه الدراسة لتسلط الضوء على الأحكام التي تقوم عليها هذه الآلية، وذلك من خلال مقدمة أبرزت فيها أساس المشكلة ومنهجية البحث، ومطلب أول تناولت فيه شروط توظيف آلية ملتمس الرقابة، ومطلب ثان خصصته لتناول إجراءات مناقشة ملتمس الرقابة وكذا آثاره القانونية وانتهى البحث بخاتمة. Abstract : There are many types of censorship exercised by the legislative authority in the face of the executive power; but its practice using the mechanism of the motion of censor is considered as the most important, the recruitment of this mechanism by the deputies and their success in exceeding its conditions and procedures lead to the political responsibility of the government. The present study aims to reveal the different provisions of this mechanism, Through an introduction that highlights the problematic and research methodology. For the first section which deals with the recruitment conditions of the motion of censor. While the second section is about the procedures to discuss the motion of censor, as well as their legal effects. finally this study ended by a conclusion.
