Résumé
L’action gouvernementale et l’action administrative étant très proche dans un contexte de droit administratif, il est nécessaire de différencier les deux procédés par leurs différents aspects et formes, les compétences qui leurs sont reliées, ainsi que leur rapport au principe de légalité et le contrôle juridictionnelle qui en découle naturellement notamment celui du conseil d’État plus haute institution judiciaire de l’ordre administratif. L’importance de cette réflexion hors mis le fait même de la distinction entre les deux procédés juridiques, demeure, en la parfaite démonstration du principe de subordination, selon lequel les institutions administratives sont soumises à l’autorité des institutions politiques. Abstract : Since government action and administrative action are very close in the context of administrative law, it is necessary to differentiate the two processes by their different aspects and forms, the competences related to them, and their relation to the principle of legality and the jurisdictional control that naturally follows, particularly that of the Council of State, the highest judicial institution of the administrative order. The importance of this reflection beyond the fact of the distinction between the two legal processes, remains, in the perfect demonstration of the principle of subordination, according to which the administrative institutions are subject to the authority of the political institutions. ملخص: نظرًا إلى أن القرارات المتخذة في ظل أعمال الحكومة (أعمال السيادة) و النشاط الحكومي متقاربين في سياق القانون الإداري، فمن الضروري التمييز بين المفهومين من خلال جوانبهما وأشكالهما المختلفة ، والكفاءات المتعلقة بهما ، وعلاقتهما بمبدأ الشرعية و الرقابة القضائية الناجمة بقوة القانون ، لا سيما رقابة مجلس الدولة ، أعلى هيئة قضائية في النظام الإداري. إن أهمية هاته التفرقة إلى جانب التمييز الفعلي بين المفهومين تكمن في التوضيح الجذري لمبدأ التبعية، والذي بموجبه تخضع المؤسسات الإدارية لسلطة المؤسسات السياسية (الأولى كأداة في يد الثانية).
