الملخص
ملخص: طبقا للمادة 24 من الأمر رقم 03-05 المتعلق بحقوق المؤلف والحقوق المجاورة، المؤرخ في 19 جويلية 2003. يتمتع المؤلف حتى بعد نشر مصنفه بحق الندم وحق السحب اتجاه المتنازل له عن حقوق المؤلف المادية، إذا وجد أن مصنفه لم يعد يتوافق مع قناعاته . ومع ذلك، لا يجوز له ممارسة هذا الحق إلا بتعويض المتنازل له مسبقًا عن الضرر الذي قد يسببه له هذا الندم وهذا السحب. الغرض من هذا المقال هو تحديد الآثار القانونية للندم والسحب على حقوق المتنازل له وبيان التزامات المؤلف. Abstract: According to Order (Act) n° 03-05 concerning the Copyright and neighboring rights, the author, even after the publication of his work, enjoys a right of repentance and a right of withdrawal vis-à-vis the assignee, if he finds that his work no longer conforms to his convictions. However, he may exercise that right only to indemnify the assignee beforehand for the damage that such repentance and withdrawal may cause him. The purpose of this article is to determine the legal effects of repentance and withdrawal on the assignee rights and to determine the author obligations.
