استقلالية المجلس الدستوري الجزائري- دراسة تحليلية The Independence Of The Algerian Constitutional Council - An Analytical Study

الملخص
يتناول هذا المقال إشكالية استقلالية المجلس الدستوري، نظرا لما يتطلبه الدور المنوط به كهيئة مكلفة بالسهر على احترام الدستور وصحة عمليات الاستفتاء وانتخاب رئيس الجمهورية، وكذا الانتخابات التشريعية وإعلان نتائجها. واختير هذا الموضوع نظرا للتعديل الدستوري الذي طال تشكيلة المجلس الدستوري وضمانات الاستقلالية الممنوحة لأعضائه بحيث نص المؤسس الدستوري صراحة على أن المجلس الدستوري هيئة مستقلة، ومع ذلك توصلنا من خلال هذا البحث أن الضمانات المستحدثة من خلال التعديل الدستوري لسنة 2016 والتي تتعلق باستقلالية المجلس الدستوري غيرلكافية لتحقيق الأهداف المنوطة به. The problematic of the article concerns the independence of the constitutional council given the requirements as to its controlling role with regard to conformity to the constitution and validity of the referendum, the election of the president of the Republic as well as the legislative elections and announcement of their result. The choice of the topic stems from the fact that constitutional reforms delayed the establishment of the council membership and provision for guaranteeing their independent role. It should be underlined that the founding constitutional principle stipulates clearly that the constitutional council is an autonomous body and for this reason the question is formulated as follows: to what extent can be the autonomy of the constitutional body be consolidated and what are the legal guarantees that can safeguard this autonomy?
