الملخص العربي: القرآن الكريم هو الدستور السماوي الذي يحمل التشريع لإرشاد الناس إلى سبل إقامة الحياة على العدل والمساواة والإنصاف، وتوجيههم نحو ما ينفعه في حياتهم وآخرتهم ، وبيان حكم الله في أمور حياتهم العامة والخاصة ، وقد حظيت المرأة المسلمة بنصيب وافر من النص القرآني؛ نظرا لأهميتها في إقامة الحياة ، وإعمار الأرض ، وقد اهتم علماء أصول الفقه ، وعلماء أحكام القرآن والمفسرون باستنباط الأحكام التشريعية المتعلقة بالمرأة عبر مراحل حياتها بنتا وزوجا(مطلقة وغير مطلقة) ، ومرضعة ومعتدة، وأما ،وأمة وحرة ، وساعدهم على ذلك اهتمامهم باللغة العربية ، والوقوف على الأحكام والتشريعات من السياق والمقام ،ونظر البحث إلى الكلمات المفردة كأفعال الأمر والنهي ، كما نظر إلى التراكيب النحوية من خلال الاستثناء والشرط ، والوصف ، والعطف. وقصد البحث إبراز الدور الفاعل للغة في التشريع النسوي . الكلمات المفاتيح: اللغة ـ التشريع ـ النسوي ـ القرآن ـ الأحكام. The role of language in feminist legislation in the Holy Quran Abstract The Holy Qur’an is the heavenly constitution that bears legislation to guide people to the ways of establishing life in terms of justice, equality and fairness, and directing them towards what benefits them in their lives and in the hereafter, and the statement of God’s ruling on matters of their public and private lives. Muslim woman has enjoyed a large share of the Qur’anic text, due to her importance in establishing Life, and reconstructing the earth. The scholars of the principles of jurisprudence, scholars of the provisions of the Qur’an and the interpreters have devoted themselves to devising legislative provisions related to woman through the stages of her life as a girl and a wife (married and divorced), nursing, a widow or a divorced woman (in her waiting period), a mother and a maid The scholars’ interest in the Arabic language, and their concern with legislation from the context has been helpful for them. The research looks at the single words as verbs of command and prohibition. It also looks at grammatical structures through exception and condition, description, and conjunction. The research aims at highlighting the active role of language in feministic legislation.
