علاقة الفساد الكبير بإختلالات البنية الدستورية

الملخص
الملخص: يمكن للدستور أن يخرج من كونه إطارا لمكافحة الفساد الكبير ليلعب دورا كبيرا في تعزيزه عن طريق استغلال إختلالات البنية الدستورية بغرض السيطرة على مراكز إتخاذ القرار في الدولة و التمتع بإمتيازات السلطة المطلقة مما يؤدي لتعظيم المنافع المادية و المعنوية للنخب السياسية المسيطرة على الحكم، و هذا ما تجسّد طوال عهدة رئيس الجمهورية الجزائرية السابق الذي قام بتفعيل ترتيبات دستورية عن طريق مباشرة عدة تعديلات دستورية آخرها كان سنة 2016 ، لترسيخ مصالح و ولاءات جديدة و الحفاظ على استدامتها الذاتية لتحقيق أهداف شخصية فهو عملية متراكبة الأبعاد أدت لخلل بنيوي داخل الدولة ساهمت في إسقاط النظام السابق و كشفت عن أكبر فضائح فساد عرفتها الجزائر، سنتمكن من خلال هاته الدراسة من معرفة كيف يمكن للإختلالات الدستورية أن تساهم في تعزيز الفساد الكبير ، من خلال إبراز خطورة إختلاله ، كما حللنا مظاهر الاختلالات الدستورية ، مع تقديم مقترحات لمعالجته . Abstract: The Constitution which is supposed to be a means to prevent corruption can, instead, play a great role in promoting it. when constitutional imbalances are used to control decision- making authority in the State . The promotion of corruption was embodied During the reign of the President of the Algerian Republic who made myriad amendments to the Constitution with the very last one in 2016. The aim of these amendments was the establishment of new interests and loyalties that would be self-sustaining to achieve personal goals. within the State which contributed to the downfall of the previous regime and which revealed the greatest corruption scandals ever known in Algeria. This study will allow us to identify how would constitutional imbalances contribute in the promotion of corruption through highlighting its gravity. Besides, we analysed the occurrence of the constitutional imbalances and provided proposals to address these imbalances.
