الترخيص المنجمي كآلية لممارسة النشاط وحماية البيئة

الملخص

جعل المشرع الجزائري النشاط المنجمي نشاطا مقننا، فلا يمكن ممارسته إلا بناء على رخصة تسلمها سلطة إدارية مختصة، حيث نجد في مجال البحث المنجمي رخصة التنقيب المنجمي وترخيص الاستكشاف المنجمي، وأما في مجال الاستغلال فنجد الترخيص باستغلال منجم صغير أو متوسط ورخصة الاستغلال المنجمي الحرفي، وخارج نظام السند المنجمي نجد رخصة الجمع واللم للمواد المعدنية رخصة استغلال المقالع والمحاجر. وأمام هذه الأنظمة المتعددة والتي تبدو في ظاهرها موحدة جاء قانون المناجم 14/05 ليوحد النظام المعتمد لممارسة النشاط المنجمي فأتى بالترخيص المنجمي وهجر السند المنجمي. حيث أنهما يختلفان في الكثير من الخصائص والمبادئ التي يقومان عليها، ورغم هذه الاختلافات فإنه يوجد بينهما قواسم مشتركة، سواء تعلق الأمر بالإنشاء أو الآثار. وهذا ما سنناقشه في هذه الورقة البحثية للوصول إلى مدى تحقيق هذا القانون لثنائية تطوير قطاع المناجم وتنميته في إطار حماية البيئة وعدم استنزاف الموارد. Abstract: The Algerian legislator has made mining a codified activity, and can therefore only be exercised on the basis of a license granted by a competent administrative authority. In the field of mining research, we find exploration license, but in the field of exploitation we find a license to exploit a small or medium mine and a license to exploit a mine. Outside the mining instrument system, there is a license to collect mineral materials and a quarrying license. To address these multiple systems, the Mines Act 14/05 was issued to standardize the legal system for mining activity. Came with mining license and give up mining bonds. They differ in the many characteristics and principles upon which they are based, and despite these differences, there are commonalities among them, in terms of construction and effects. This is what we will discuss in this paper to reach the effectiveness of this law in achieving the double development of the mining sector and development within the framework of environmental protection and non-exhaustion of resources.
