الملخص
الملخص . تعتبر سلطة ضبط الصحافة المكتوبة من السلطات المستقلة التي تم استحداثها لضبط الإعلام المكتوب و تتمتع هذه السلطة في إطار قيامها بمهامها بمجموعة من الصلاحيات التي يمكن أن تؤدي إلى تقييد حرية الصحافة المكتوبة هذه الأخيرة التي تعتبر من الحريات الأساسية المعترف بها في المواثيق الدولية و القوانين الداخلية لذلك يثار الإشكال حول التوازن بين السلطة والحرية والضمانات المنصوص عليها في الدستور لاسيما المادة 50 منه و القانون العضوي 12/05 المتضمن قانون الإعلام لحماية حرية الصحافة بمنع تعسف سلطة الضبط و حماية النظام العام و ذلك بمنع الأفراد من الإخلال به أثناء ممارستهم لحرية الصحافة المكتوبة لذلك حاول المشرع تحقيق هذا التوازن من خلال الاعتراف لسلطة ضبط الصحافة المكتوبة بالاستقلالية عن السلطة التنفيذية و كذلك فرض الرقابة القضائية على قرارات سلطة الضبط التي تمس بحرية الأفراد لاسيما قرار رفض الاعتماد ، غير أنه، وعلى اعتبار أن فرض الاعتماد في حد ذاته يعتبر قيدا للحرية فإنه قد يختل التوازن بين السلطة ،والحرية في صلاحيات سلطة ضبط الصحافة المكتوبة لذلك لابد من استبدال الاعتماد بالإخطار أو تحديد القانون على سبيل الحصر للحالات التي يمكن فيها لسلطة ضبط الصحافة المكتوبة رفض منح الاعتماد حتى لا تتعسف سلطة ضبط الصحافة المكتوبة في استعمال صلاحيتها . Summary . The authority to control the written press is an independent authority established to control the written media. In the exercise of its duties, this authority has a set of powers that can restrict the freedom of the written press, which is considered one of the fundamental freedoms recognized in international conventions and internal laws. The issue is about the balance between power and freedom and the guarantees provided for in the Constitution, especially article 50 thereof and organic law 12/05, which includes the media law to protect the freedom of the press by preventing the arbitrariness of the control authority and protecting the public order by preventing individuals from violating it. The legislator tried to achieve this balance by recognizing the written press control authority independently of the executive branch, as well as judicial control over the decisions of the control authority that affect the freedom of individuals, especially the decision to refuse accreditation. However, It is a restriction of freedom. It may alter the balance between power and freedom in the powers of the written press. Therefore, the accreditation must be replaced by notification or the law, except for cases in which the authority of the written press can refuse to grant accreditation, Adjust the written press in the use of its validity. Résumé. L’autorité de régulation de la presse écrite est l’une des autorités indépendantes créées pour contrôler la presse écrite, dotée d’un ensemble de pouvoirs pouvant restreindre la liberté de la presse écrite, qui est l’une des libertés fondamentales reconnues dans les conventions internationales et les lois internes. La question se pose quant à l'équilibre entre pouvoir et liberté et aux garanties prévues par la Constitution, en particulier l'article 50 et la loi organique 12/05, qui inclut la loi sur les médias pour protéger la liberté de la presse en empêchant le contrôle arbitraire et l'ordre public en empêchant les individus de la violer. Par conséquent, le législateur a tenté de parvenir à cet équilibre en reconnaissant que l'autorité de la presse était indépendante du pouvoir exécutif et en imposant également un contrôle juridictionnel aux décisions de l'autorité de contrôle qui portent atteinte à la liberté des individus, en particulier à la décision de refuser une accréditation. La même chose est considérée comme une restriction de la liberté car elle peut perturber l'équilibre entre l'autorité et la liberté dans les pouvoirs de l'autorité de contrôle de la presse écrite. Contrôler la presse écrite dans l'utilisation de sa validité.
