الملخص

ملخص دخلت التكنولوجيا بقوة على الخط لتغيير الكثير من المقاييس المتعارف عليها ووضع الانترنت بصماته في جميع مجالات الحياة، فأضحى التعامل بهذه المخترعات في إبرام العقود المالية والتجارية وحتى الشخصية كالزواج، كإبرام عقد الزواج عبر وسائل الاتصال الحديثة، ولكن هذا النوع من الزواج يتطلب الحماية والإثبات ، وهذا ما يدفعنا لطرح التساؤلات هو مدى سلطة قاضي شؤون الأسرة في إثبات الزواج الالكتروني؟ والي أي مدى يمكن إثبات هذا الزواج؟ وما هي الوسائل الحديثة لإثبات الزواج الالكتروني؟ ولهذا فانه يكتسي أهمية بالغة من حيث تأثر قضايا شؤون الأسرة لمثل هته المستجدات، وهو الدافع للفت انتباه المجتمع الجزائري إلى ما استجد حوله من وسائل جديدة تستعمل في عقد الزواج، وبالتالي تنبيه المشرع الجزائري إلى هذا الموضوع الحساس لوضع الإطار القانوني الذي يضبطه. Abstract : Technology has strongly acceded to change many of the accustomed criterias and the internet has put its stamp in the different areas of life, and the use of said inventions in the establishment of financial, commercial, and personal acts, including marriage, and for example the establishment of the marriage certificate by the new means of communication, however this type of marriage, requires protection and confirmation, this is what drives us to ask questions, what are the powers of the family court judge in the confirmation of the electronic marriage? and how much can we confirm the electronic marriage? So it has a great importance and a very important impact on the family instances modifying these novelties, it’s what pushes the Algerian society, with the new means used in the act of marriage, indeed, to warn the legislator Algerian about this very sensitive subject, to put the legal setting regulating it Résumé: La technologie a accédé d’une manière très forte pour changer beaucoup de critères accoutumés et l’internet a apposé son empreinte dans les différents domaines de vie, l’utilisation des dites inventions dans l’établissement des actes financiers, commerciaux, et personnels, y compris le mariage,et à titre d’exemple l’établissement de l’acte de mariage par les nouveaux moyens de communication, cependant ce type de mariage, nécessite la protection et la confirmation, c’est ce qui nous pousse à poser des questions, quels sont les pouvoirs du juge des affaires familia les dans la confirmation du mariage électronique, et à quel point nous pouvons confirmer le mariage électronique?et sur ce il a une grande importance et un impact très important sur les affaires familiales modifiant ces nouveautés, c’est ce qui pousse la société algérienne,aux nouveau moyens utilisés dans l’acte de mariage,en effet,d’avertir le législateur algérien à ce sujet très sensible pour mettre le cadre juridique le réglant
