الملخص

تندرج هذه الدراسة في إطار إبراز مسؤولية الأسرة بالمغرب الأوسط في حماية أبنائها والتكفل بحقوقهم، من خلال تحرير وثائق عدلية لدى القضاة والموثقين تم الإشهاد عليها، تتعلق بتأمين مستقبل أبنائها وتغطية احتياجاتهم. كما أن الدراسة استفادت من مصدر يعد جديدا نسبيا، وغنيا بمعلومات قيمة في مجال التاريخ الاجتماعي للمغرب الأوسط –خلال الفترة الوسيطية- ،منها ما تعلق بالأسرة عموما والمرأة والطفل خصوصا والذي لازال موضوعها بكرا لم يسبر أغواره الباحثون، كمالم يهتم المحققون بمجال تحقيق الكنوز المخطوطة للمغرب الإسلامي بمخطوط "قلادة التسجيلات والعقود وتصرف القاضي والشهود" للمازوني المغيلي أنموذجا. ونهدف من خلال هذا البحث إلى تسليط الضوء على مخطوط المغيلي وما يحويه من نصوص وثائقية تتعلق بحياة الطفل داخل الأسرة بالمغرب الأوسط في -العصر الإسلامي الوسيط- ،والتي تكشف بأن مجتمع المغرب الأوسط (الجزائر) في إطار التشريع الإسلامي والحضارة الإسلامية كان رائدا في مواكبة ما يعرف في عصرنا الحالي "حقوق الطفل" على كافة المستويات من تسمية وتغذية سليمة وتعليم جيد وحريات وغيرها، وهو ما تسعى حاليا المواثيق الدولية إلى إرسائه من خلال منظمات عالمية كمنظمة " اليونسيف". Through the collation of registrations, contracts, the judge behavior and witnesses of " El Mazouni El Meghili That’s why I try through the present study to shed light on the work of El Meghili and what it contains of documentary texts that concerned the life of the child within the family of the middle Maghreb - Islamic middle era - . That reveals that the middle Maghreb society (Algeria) in the scope of islam legislative and Islamic civilizations were the first and leader of the concept of Child Rights at all levels as have the right to a .name, healthy nutrition and good learning, freedoms and so on International charts are actually desperately seeking to spread it through the international organizations such as the UNISCO .Organization
