منهج المالكية في ضبط مراتب عمل أهل المدينة وأثره في تحديد مفهومه - منهج الإمام الأبياري أنموذجا- The Maalikis's Approach In Controlling The Degrees Of The Work And Its Impact In Defining Its Concept Imam Abiari Model

الملخص
يعدّ الإمام مالك - رحمه الله تعالى - أحدَ الأئمة الأعلام الذين كتب اللهُ لمذاهبهم القبولَ والانتشار؛ وليس ذلك إلا لجودة الأصول التي كان يُصدر عنها في اجتهاده. وبالرغم من كون عمل أهل المدينة أشهرَ تلك الأصول على الاطلاق ؛ إلّا أنّ مالكا - رحمه الله - لم ينصّ صراحة على قصده بالعمل؛ ممّا أدّى إلى غموض هذا الأصل عند غيره من أعلام عصره وأتباعهم. وإنّ النّاظر في مناهج المالكيّة في التطرّق إلى موضوع عمل أهل المدينة - كالإمام ابن القصّار، والقاضي عبد الوهّاب، والقاضي عيّاض، وابن رشد، وغيرهم -، يستجلي إثارَتهم لمبحث مراتب العمل، محاولة منهم لتقريب معنى العمل الذي يحتج به مالك، فتندفعُ من خلال ذلك الكثيرُ من الانتقادات التي وجّهت له فيما يتعلّق بهذا الأصل، ولعلَّ الإمامَ الأبيّاريّ من أهمّ من اعتنى ببيان تلك المراتب وتفصيلها، وما هو منها حجّة عند مالك تُبنى عليه الأحكام وما ليس كذلك؛ وذلك من شأنه أن يضبط حدود هذا الأصل ومعالمه. El imam malek - blessings be upon him - is one of the most renowned Islamic scholars whose doctrines had been widely spread over the Muslim nation for the valuable origins by which he could publish subjects about the Islamic law depending on his personal diligence. Despite the fact that the Madina mounawara people’s work was one of the most famous origins ever, Malek -blessings be upon him – did not mention what that origin ( the work of people of Al Madina El Mounawara ) means , something that made that origin unclear and mysterious to the scholars and the followers of his period. Besides , whoever takes a look over the approaches of El Malikiya ; the way they dealt with the subject of Al Madina El Mounawara people’s work (such as El imam Ibn El kassar, El kadi Ayyad, El kadi Abd El Wahab , Ibn Rochd ,and others )would notice their interest in researches about the status of this work trying to distance the meaning of the work that Malek used to defend his judgments which had been protested by other scholars about that origin. El Imam El Aybari was one of those scholars who were keen to clarify and give the full particulars of that work and decided what Imam Malek considered as a proof and what he did not. That could reshape the structure of that origin and its concepts
