الملخص
الملخص: من مظاهر العنف بين الزوجين ارتكاب جرائم الجرح أو الضرب العمدي والذي انتشر في مجتمعنا هو ما دفع بالمشرع الجزائري إلى التدخل في محاولة لمواجهة هذه الظاهرة من خلال تجريمه لكل أفعال الضرب أو الجرح العمدي بين الزوجين، بما فيها الضرب الخفيف للزوجة الذي يعد وسيلة للتأديب إذا توافرت شروطه وفقا لأحكام الشريعة الإسلامية، كما تم التشديد في العقوبات المقررة على نفس الجرائم مقارنة بما هو مقرر وفقا للقواعد العامة تحقيقا للردع الخاص والعام إذ يتم تطبيق التشديد حتى في حالة انتهاء الرابطة الزوجية إن كانت الأفعال المجرمة ذات صلة بها، ولقد تم النص على الصفح كسبب لانتهاء المتابعة الجزائية في بعض جرائم الجرح أو الضرب العمدي بحسب النتيجة المترتبة عنها، إضافة إلى استبعاد تطبيق الظروف المخففة في حالات معينة تتعلق بالضحية أو بظروف ارتكاب الجريمة. Summary: One manifestation of spousal violence is the intentional wounding or beating that has spread in our society, which has promoted the Algerian legislature to intervene in an attempt to confront this phenomenon by criminalizing all acts of beatings or intentional wounding between the spouses, including the slight beating of the wife, which is a means of disciplining if Its requirements are in accordance with the provisions of the Islamic law, and the penalties prescribed for the same offences are emphasized in comparison with those established in accordance with the general rules in order to achieve private and public deterrence, since the emphasis is applied even if the marital association ends if the criminal acts are related to it, and it is provided for Forgiveness as a reason for the end of the penal follow-up in some crimes of wounding or intentional beating according to the result thereof, as well as the exclusion of the application of extenuating circumstances in certain cases concerning the victim or the circumstances of the Commission of the crime.
