حقوق المعتدة وواجباتها في التشريع الجزائري

الملخص
يعتبر الزواج في الشريعة الإسلامية الركيزة الأساسية لبناء الأسرة في جو يسوده المودة و المحبة بين الزوجين والتي يظهر أثرها على المجتمع إذا حسن صلاحها ولكن أحيانا قد يتعكر هذا الجو بسبب انحلال الرابطة الزوجية بالطلاق أو الوفاة أين يترتب اثر هام وهو ما يعرف بالعدة أي المدة التي تتربص فيها المرأة وتمتنع عن الزواج في تلك الفترة ، حيث منح الشارع الحكيم حقوقا للمعتدة وواجبات وهي تختلف حسب أساس فك الرابطة الزوجية وفيما إذا كان المشرع الجزائري قد وفق بالإحاطة بهذه الأحكام لاسيما أنواع العدة وأسبابها وحقوق المعتدة وواجباتها حيث نبين أهم الانتقادات و نقدم بعض النتائج والتوصيات في حدود الشريعة الإسلامية باعتبارها مصدر لقانون الأسرة في الجزائر. Marriage is considered in the Islamic law (Sharia) as the cornerstone of building the family in an atmosphere of affection and love between the spouses that positively affects the society. However, sometimes this atmosphere may become turbid because of the dissolution of the marital bond by divorce or death where there is a significant impact, which is known as the iddah, the period in which the woman has to stay in her husband’s house and refrain from marrying. The lawgiver gave rights and duties to the widow or divorced woman in the waiting period that varies according to the reasons of the dissolution of the marital bond. This paper investigates whether the Algerian legislation has beenin accordance with these provisionsespecially the types of Iddah and its causes and the rights and obligations of thewidow or divorced woman in the waiting period. This study also exposes the most important critiques and presents some conclusions and recommendations within Islamic Sharia as the source of the family code in Algeria.
