دور القاضي العادي في ضبط السوق

الملخص
ملخص: تعتبر السلطة القضائية الهينة المكرسة قانونا لرقابة تصرفات الأشخاص في المجتمع بشكل عام. وتهدف هذه الرقابة إلى المحافظة على الحقوق والحريات منها ضمان حقوق الدفاع، ومن التصرفات التي تخضع لهذه الرقابة نجد الرقابة على أعمال الإدارة عندما تصرف بصفة انفرادية وهذا عند إصدارها للقرارات الإدارية. هذا المعنى ينطبق على كل أنواع الإدارات من بينها سلطات الضبط المستقلة المنشئة في المجال الاقتصادي منها مجلس المنافسة باعتباره سلطة ضبط إدارية بصريح النصوص القانونية المنظمة له والمتمثلة على وجه التحديد في قانون المنافسة الصادر بموجب الأمر رقم 03-03 المعدل والمتمم. وتسمح هذه الرقابة بضمان التأطير القانوني لعمل هذه الهيئة وإخضاعها للقانون بمنعها من التعسف في تطبيق القانون إزاء المتعاملين الاقتصاديين. والقاضي المختص في هذا الإطار وعلى غير العادة هو القاضي العادي باستعماله لأساليب معينة. الكلمات المفتاحية: القاضي العادي ، المنافسة-،الضبط. Abstract: The judicial authority, legally created to control the conduct of individuals in society in general, The purpose of this control is to preserve the rights and freedoms, including by guaranteeing the rights of the defense, and the acts being the subject of this control. One of the actions subject to such censorship is to monitor the work of the administration when acting unilaterally when taking administrative decisions. This meaning applies to all types of administration, including independent supervisory authorities established in the economic field, and the Competition Council as the authority of administrative control, governed by explicit legal the law on competition published by the ordinance n ° 03-03, modified and completed. This control makes it possible to legally control the work of this body and subject it to the law by preventing it from arbitrariness in the application of the law to economic agents. The competent judge in this context and exceptionally is the ordinary judge to use it for certain methods.
