سلطة القاضي المدني إزاء تقرير الخبرة القضائية The Authority Of Civil Judge About The Report Of Judicial Expertise

الملخص
تناولنا بالدراسة القيمة القانونية لتقرير الخبير المتندب أمام القضاء المدني ، من خلال معالجة سلطة المحكمة إزاء تقريره ، ذلك أن قاضي الموضوع بعد اطلاعه على تقرير الخبير قد يجد من الأفضل استدعاء الخبير ومناقشته في الجلسة وتوجيه بعض الأسئلة له إذا كان التقرير غامض يحتاج إلى تفسير، أو يأمر الخبير بتدارك نقص أعماله ، وربما لا يقتنع القاضي بالخبرة المنجزة ، فله استكمالا للمأمورية نفسها أن يصدر حكما بخبرة جديدة. وعالجنا أيضا مدى تقيد المحكمة برأي الخبير، في أنها تملك حرية الأخذ بالتقرير كله أو بعضه، أو رفضه، والاستثناءات الواردة التي تحد من سلطة القاضي في تبني رأي الخبير سواء بنص قانوني أو طبقا للمبادئ القضائية، و قدمنا ثلاث اقتراحات نرى انها مفيدة للخبير المنتدب ، القاضي ، المتقاضي، والعمل القضائي. Summary We dealt with the legal study of the exprt's report befor the civil judgiciary through the treatment and authority of the court over his report the judge of subject after reviewing the report of expert may find it better to call him and discuss in the court session and ask some questions to him if the report is ambiguous need to explain or order the expert to correct the luck of his work the judge may not be convinced of the expertise that has been accomplished in order to complement the mandate itsef to issue a judgment of new expertis We also addressed the extent to with the court restricted to the expert's opinion that it has the freedan to take all or part of the report or refuse it and the incoming cansultation that limit the judage's authority to adopt the opinion of the expert whether by legal or judicial principles We have made three suggestions that we be lieve are useful to the expert the judge- the litigant and the judicial work.
