الاستشارة في الفكر الإسلامي والإدارة العامة: الوظائف والأبعاد

الملخص
ملخص: لقد جعلت الشريعة الإسلامية من الشورى نظاما عاما تسير عليه الأمة في تنظيم أمورها وتدبير شؤونها لتحقيق المصالح العامة في الأمور الدينية والدنيوية بما لا يتعارض مع النص أي هي إجتهاد خارج النص لجلب المصالح ودرء المفاسد وبهذا تغدو الشورى أساسا ومبدأ رئيسيا للحكم والإدارة تحقيقا لفعلية الأداء وسلامة القرار. فالشورى من المبادئ الثابتة في الإدارة الإسلامية ونظام الحكم فيها فلا غنى لأولياء الأمر عن المشاورة في الأمور التي تتعلق بشؤونهم العامة المستجدة التي ليس فيها حكم بنص القرأن أو السنة، فلقد أمر الله سبحانه وتعالى نبيه محمد عليه الصلاة والسلام بها فكيف بغيره؟ فالشورى نظام حوار العقول لإستخراج الحلول لمعضلات الشؤون فيما ليس فيه حكم بما يوافق كتاب الله وسنة رسوله في الأمور كلها، فهي تهدف إلى التعاون بين الحاكم والمحكوم للوصول إلى حل للمشاكل المستجدة بما يوافق كتاب الله وسنة رسوله صلى الله عليه وسلم. كما أنها قناة للحوار بين الحاكم ورعيته للوصول إلى الحلول السليمة للمشاكل التي تعترضها وهي في الوقت نفسه وسيلة لكبح وكشف الاخطاء الملازمة لمصدري القرارات. وهكذا يعد العمل الإستشاري من الركائز الأساسية التي يقوم عليها النشاط الإداري اليوم نتيجة التطورات الإقتصادية والإجتماعية وتعقد وتعدد المشاكل والمعوقات التي تواجه الإدارة في تحقيق التنمية حيث تجمع لها الطاقات البشرية والمادية اللازمة لتحقيق ذلك. Abstract: The sharia law has made shura a general system for the nation to organize its affairs and to manage its affairs in order to achieve public interests in matters of religion and mundaneity in a way that does not conflict with the text, ie, diligence outside the text to attract interests and prevent evil. . The shura is one of the tenets of the Islamic administration and its system of government. The parents are not required to consult in matters related to their emerging public affairs, where there is no ruling on the text of the Qur'aan or Sunnah. The Prophet, may Allah bless him and grant him peace, It is a system of dialogue of minds to find solutions to the dilemmas of affairs, while there is no provision for the approval of the Book of Allah and the Sunnah of His Messenger in all matters. It aims at cooperation between the Ruler and the Ruler to reach a solution to the emerging problems, according to the Book of Allah and the Sunnah of His Messenger. It is also a channel of dialogue between the ruler and his sponsor to reach the right solutions to the problems they face while at the same time a means to curb and detect the mistakes inherent to the decision makers. Thus, the consultative work is one of the basic pillars on which the administrative activity is based today due to economic and social developments and the complexity and multiplicity of problems and obstacles facing the administration in achieving development, where it has the necessary human and material resources to achieve this.
