الملخص
من أعظم العقود و أرفعها منزلة، عقد النكاح، إذ وصفه الله عز وجل في كتابه العزيز بالميثاق الغليظ، فأولاه الشارع الحكيم بعناية كبيرة، حفظا للفروج و لنجنبه كل ما يصرفه عن تحقيق غاياته. غير أنه، ولما شهده العالم من تطور في مجال التقنيات المعاصرة مكن الناس من التخاطب بينهم و إجراء العقود دون حضور مجلس واحد، و كان لعقد الزواج نصيب من هته التقنيات بما سهل على الخاطبين تبادل صيغة الزواج عبر هته التقنيات دون عناء. إذ ستتناول هذه الدراسة مسألة مستجدة في باب النكاح، لتبيان مدى مشروعية إنعقاد صيغة النكاح عبر هته التقنيات المعاصرة. English abstract : One of the greatest and most prestigious contracts is the marriage contract, as God Almighty described in His Great Book as the Great Charter. The wise street followed it with great care, in order to preserve the offspring and protect the proportions and avoid all that distracts from achieving its goals. However, as the world witnessed a development in the field of contemporary technologies, people were able to communicate with each other without holding a single council. The marriage contract was part of these techniques, which made it easier for the suitors to exchange the marriage formula through the techniques without any trouble. This study will address a new issue in the chapter on marriage, to show the legitimacy of the marriage through modern technologies
