جريمة تزوير التوقيع الإلكتروني في التشريع الجزائري

الملخص
فرض التطور التكنولوجي استخدام التوقيع الإلكتروني في المعاملات اليومية، وصاحب هذا التطور كثرة الاعتداءات على هذا النوع من التوقيع، وذلك بتزويره بغية الحصول على منافع غير مشروعة. فبالرغم من صدور الأمر 15/04 الذي يحدد القواعد المتعلقة بالتوقيع والتصديق الإلكترونيين، إلا أنه لم يتناول أحكام هذه الجريمة، مما يثير إشكالا حول القواعد المنظمة لهذه الجريمة، هل تنطبق عليها نصوص جريمة التزوير التقليدي، أم تلك الخاصة بالجرائم الماسة بالأنظمة المعلوماتية، أم أنها تحتاج إلى نصوص مستقلة؟ Le développement technologique a imposé l'utilisation de la signature électronique dans les transactions quotidiennes, ce type de signature a incité certains professionnels de tenter d’en bénéficier illégalement par le crime de falsification. Le législateur algérien n’a pas prévu expressément la criminalisation de cet acte, malgré la promulgation de la loi 15/4 qui définit les règles générales de signature et de ratification électronique, ce qui pose une problématique au tour des textes applicables. Dans ce cas, faut-il protéger cette signature en vertu des textes traditionnels ou par les dispositions de crimes de traitement automatique des données, ou bien avons-nous besoins de textes spéciaux ? Technological development has imposed the use of electronic signature in daily transactions, this type of signature has prompted some professionals to try to benefit illegally by the crime of falsification. The Algerian legislature did not expressly foresee the criminalization of this act, despite the promulgation of Law 15/4 which defines the general rules for electronic signature and ratification, which poses a problem in the turn of the applicable texts. In this case, should this signature be protected under the traditional texts or by the provisions of automatic data processing crimes, or do we need special texts?
