أثر القوانين الوضعية في تغيّر الفتوى الشرعية. Effect Of The Statutes Laws On Changing Of Shari'a Fatwa

الملخص
يعالج هذا البحث قضية جوهرية تندرج في إطار تغيّر الفتوى الشرعية, ويسلط الضوء -بوجه خاص-على طبيعة علاقتها ومدى تأثّرها بالقوانين الوضعية, وهل يمكن أن تلعب هذه الأخيرة دورا في تغيير مسارها, وتكون أحد دواعي تبدّلها ؟. وقد تطرّقت فيه لمفاهيم ومدلولات كلّ من القوانين الوضعية, والفتوى الشرعية, وتحديد أبرز ملامحهما الجوهرية؛ ثمّ عرّجت على بيان المقصود بتغيّر الفتوى, وأشرت إلى مناطه العام؛ لأنتقل بعدها إلى الكلام عن مدى تأثير القوانين الوضعية في تغيّر الفتوى الشرعية؛ ثم عرضت في الختام مجموعة من النتائج والتوصيات التي تخدم موضوع الدراسة. Abstract This search addresses a fundamental issue fall under a change of sharia fatwa,and particularly highlights on the nature of their relationship and extent to which they are affected by the statutes laws, and can it play a role in changing its cours, and be one of the reasons for the change? It touched upon concepts and meanings of the laws the statutes laws and shriah fatwa, and identify their most significant featurs; then I asked to explain the intention to change the fatwa qnd I pointed to its general nationlity; i then turn to talk about the impact of the statutes laws in changing shriah fatwa ; then I presented in conclusin a set of findings and recommondations that serve the subject of study.
