مشروع نظام الافلاس السعودي بين القبول والرفض: دراسة نقدية

الملخص
لما كان تنظيم الإفلاس لازماً لحماية القيمة الاقتصادية للعمل التجاري في حياة المجتمعات وحماية أطرافه تجاراً كانوا أم غير تجار، فقد اعتنت به التشريعات اعتناء بالغاً، وجاء الفقه الإسلامي بمنظومة رائدة ثرية من الأحكام في تعريف المفلس وبيان شرائط الحجر عليه والآثار التي تتعلق بالحجر، وظل الإفلاس يشغل بال المهتمين بالشأن التجاري والاقتصادي، بل التنموي، وبسطت له الدول من الأنظمة ما تراه محققاً لمصلحة التجارة والاستثمار فيها. يحاول هذا البحث أن يستعرض هذا المشروع من خلال قراءة قانونية نقدية لمواده من خلال التعريف بمشروع نظام الإفلاس ( المبحث الأول ) والإجراءات الواردة في مشروع نظام الإفلاس التي تحكم تصرفات المدين لتصحيح أوضاعه والاستمرار في ممارسة نشاطه دون الإخلال بحقوق دائنيه وغيرهم من أصحاب المصالح ( المبحث الثاني ) وتقييم مشروع نظام الإفلاس ( المبحث الثالث ) وخاتمة تضم أبرز النتائج والتوصيات.
