مقاصد العقوبات الشرعية ومظاهر الرحمة في تنفيذها

الملخص

This article studies and analyses the extent of rightness on the pretence of doubting on the adequacy of applying the Islamic criminal acts, especially the punishment acts. It's said that the Islamic acts –in this field- are so hard and severe, which made it –as they said- inhuman! And didn't go with the modern life and its spirit and theories, such as the theory of analysing the psychology of the criminals. This claim is treated in this article through the following: 1. Clarifying the aims of the criminal legislation in Islam. 2. Sitting some facts about the Islamic criminal legislation, which disprove the suspicions and assertions of the doubtful pretences, and crumble it down. 3. Discussing some proofs and evidences which light the aspects of mercy and pity in applying the legal punishments on whom deserves it. Finally, this research concluded that the pretence of doubting on the adequacy of applying the Islamic criminal acts is vanish, unproven, and baseless.
