آلية التصديق الإلكتروني كضمانة للتعاملات التجارية بالوسائل الحديثة في التشريع الجزائري "the Authentication Mechanism Of Electronic Security For Commercial Dealings With Modern Facilities In The Algerian Legislation"

الملخص

أصبح التعاقد باستعمال الوسائل الالكترونية الحديثة الأكثر شيوعا في مجال التجارة، إلا انها لا تخلوا من مخاطر القرصنة والاحتيال، ولبعث الثقة والأمان في مثل هذه التعاملات، الأمر الذي استدعى تدخل الأنظمة القانونية لوضع الإطار القانوني الذي يحكم العلاقة . ولقد حاول المشرع الوطني من خلال إصداره للقانون رقم(15/04) المحدد للقواعد العامة المتعلقة بالتوقيع والتصديق الإلكترونيين، وضع أحكاما تضمنت آلية التصديق الالكتروني حتى يصبح للتوقيع الالكتروني حجية تضاهي حجية التوقيع التقليدي، لما حدد الجهة المكلفة بها والشهادات التي تصدرها، ونطاق مسؤوليتها في حالة إخلالها بالتزاماتها . Abstract: Recruitment has become the use of modern electronic means, most commonly used in the field of trade, but the risk of piracy and fraud is still there . To establish trust and safety in such transactions, the intervention of legal systems to develop a legal framework that governs the relationship, was necessary. The national legislature has attempted through the issuance of Law No. (15/04), which sets the general rules related to the electronic electronic signature and authentication, and also attempt to set provisions, including electronic authentication mechanism, so that the electronic signature Authenticity is comparable to that of the traditional one . selecting the body tasked, and the certificates issued by it , and The scope of responsibility in case of breach of obligations.
