التجديد في التفسير : التفسير الفقهي أنموذجا Renewal In Interpretation: The Doctrinal Interpretation As A Model

الملخص
يبحث هذا المقال في عملية التجديد في التفسير عموما من خلال بيان حقيقته وضوابطه، ويخص بالبحث نوعا من أنواع التفسير وهو التفسير الفقهي؛ لما لهذا النوع من اهتمام بواقع الناس المتجدد بمرور الأزمنة واختلاف الأمكنة. فالتفسير نتاج عصر المفسر وبيئته، ولكي يساير الواقع لابد له من عملية التجديد، حتى يحقق مقصد مراعاة تغير أحوال الناس واختلاف بيئاتهم، ليجد فيه كل أهل عصر ما يوافق واقعهم المعيش. ويستنبطون منه الأحكام الشرعية لما يستجد لهم من أقضية. إن التفسير الفقهي مجاله الأحكام العملية؛ أي بالفقه، والفقه موضوعه الحياة، وأمور الحياة متجددة، بتجدد الوقائع والحوادث، وقضايا الناس غير منتهية، بينما النصوص الشرعية منتهية. مما يقتضي الاجتهاد في إيجاد الأحكام الشرعية لما يستجد من أمور حياة الناس. والاجتهاد في هذه القضايا يعتمد على الكتاب والسنة. إن التفسير الفقهي قد تطور من حيث المنهج. فالتفاسير الفقهية القديمة كانت تعتمد في بيان الأحكام الفقهية على قواعد مذهب من المذاهب الفقهية، مع المقارنة بغيره من المذاهب في بعض المسائل. بينما التفاسير الفقهية الحديثة تعتمد منهج الفقه المقارن في الغالب؛ أي تجمع بين آراء المذاهب، وتبين منهج كل مذهب. مع إيراد بعض القضايا المستجدة، وبيان حكمها الشرعي. ويبقى التجديد في التفسير عموما والتفسير الفقهي خصوصا مطلبا ملحا لكن بضوابط محددة حتى لا يخرج عن الإطار المرغوب والمقصد المشروع. This article studies the process of renewal in the interpretation of Quran “tafsir” –in general-through stating its meanings and standards, emphasizing on a kind of an interpretation: the doctrinal interpretation; which is related to the peoples’ real life and interests over times and in different places. The interpretation of Quran is the product of the era of the interpreter and its environment, and in order to keep its reality, tafsir must have a process of renewal, to go with the changed conditions of people and their different environments, and needs. To derive legal provisions of the emerging acts, in every district. The field of jurisprudence interpretation is the practical provisions. The theme of jurisprudence is life and its renewed facts and incidents, and issues to the people are limitless, while religious texts are limited. Which requires diligence in finding legal provisions to the emerging issues of peoples’ lives. And diligence in these cases must be based on Quran and Sunnah. Jurisprudential interpretation progressed methodologically. Ancient jurisprudential Tafsirs were dependent on the rules of one of the doctrines of Islamic jurisprudence, with a comparison to the other doctrines in some matters. While interpretations of modern jurisprudence were –often- based on the approach of comparative jurisprudence; through gathering several views, showing the approach of every doctrine. With the statement of some emerging issues, and their renewal in interpretation in general, and in jurisprudential explanation especially, remains an urgent requirement, but the specific controls so as not to deviate from the desired frame and destination project.
