الآليات القانونية المستحدثة لحماية الشهود والخبراء والضحايا بموجب الأمر 15-02 المعدل لقانون الإجراءات الجزائية (دراسة مقارنة)

الملخص
يُعتبر الشهود والخبراء والضحايا حجر الزاوية في مجال مكافحة الجريمة المنظمة والإرهاب والفساد، وهو ما تفطن له المشرع الجزائري وكان الدافع وراء إصداره للأمر 15-02 المعدل لقانون الإجراءات الجزائية، بحيث أضاف عشرة مواد تتضمن تدابير إجرائية وغير إجرائية، لا يُلجأ إليها إلا إذا كانت حياة المعني أو أحد أفراد عائلته أو مصالحه الأساسية في خطر، لا يمكن تفاديه إلا من خلال إعمال التدابير هذه، من قبل وكيل الجمهورية أو قاضي التحقيق أو قاضي الحكم. الأمر 15-02 ملأ الفراغ القانوني الذي شاب التشريع الجزائري فيما يتعلق بحماية المعنيين، إلا أنه يحتاج إلى تلافي النقائص التي تخللته، كسقوط الضحية والمبلغ من تدابير الحــماية، وغياب التفاصيل التي من شأنها جعل هذه التدابير قابلة للتطبيق، والتي من الأحسن أن يكون محلها قانون خاص بحماية الشهود والخبراء والضحايا وهو المعمول به دوليا. تبنى المشرع الجزائري هذه التدابير استجابة لتوصيات اللجنة الوطنية لإصلاح العدالة، ووفاء بالتزامات الجزائر الدولية، ومجاراة للتوجه الدولي في القوانين المقارنة، بهدف إدخال معايير جديدة في النظام الجزائي الجزائري، تتعلق بحقوق الإنسان وعصرنة العدالة. Witnesses and experts and victims are the cornerstone in the fight against organized crime and terrorism and corruption, which is why the Algerian legislature adopted the ordinance 15-02, and introduced amendments of the code of criminal procedure, adding ten articles containing procedural and non-procedural measures. These measures are used only if the life of the person concerned or those of his family members or essential interests are in danger. Order 15-02 has filled the gaps in the matter, but on the other hand the legislator has excluded victims and whistleblowers from protection measures, and the absence of details that make the measures applicable, and it preferably should be the subject of a law dedicated to the protection of witnesses and whistleblowers and experts and victims in accordance with international practice. The legislature adopted this measures following the recommendations of the National Commission for the Reform of Justice, and also following the ratification of several relevant international treaties, and to follow practice compares, in order to incorporate new criteria into the penal system Algerian conflict, linked to human rights and the modernization of justice.
