الملخص
تبنى المشرع الجزائري العديد من المبادئ التي ترمي إلى حماية العناصر البيئية قبل تضررها لاسيما تلك التي تتسبب فيها المشاريع الصناعية عموما والاستثمارية على وجه الخصوص، الأمر الذي دفع بالمشرع إلى وضع مختلف الآليات والوسائل التي من شأنها العمل على تجسيد هذه الحماية على الأرض الواقع، والمتمثلة على وجه الخصوص في مبدأ الحيطة. يتطرق هذا المقال إلى مفهوم مبدأ الحيطة ومضمونه وشروطه، وكذا إلى آلية دراسة مدى التأثير على البيئة كآلية لتجسيد مبدأ الحيطة، كما يتم التطرق أيضا إلى علاقتها مع مبدأ الحيطة في حماية المجالات البيئية من مخاطر المشاريع الاستثمارية.
