الملخص
تقوم فكرة هذا المقال على مناقشة مصطلح "فلسفة الفقه" واستعمالاته لدى الباحثين المعاصرين والتفريق بينه وبين المصطلحات القريبة منه، وبغية الخروج من الغموض والاعتراضات التي صاحبته فإني أقترح بديلا له هو "الفكر الفقهي"؛ مما استدعى بيان المراد منه وفائدته، ونماذج من المصنفات التي اشتملت عليه أو على مباحث منه، وتحقيقا لمقتضى العنوان وضعت أنموذجا لمفردات مقرر "الفكر الفقهي" ليكون من مقررات كليات ومعاهد الشريعة. ABSTRACT The idea of this article is to discuss the term "philosophy of Fiqh" and its uses by the contemporary scholars and the differentiation between it and the nearby terms, in order to get out of the mystery and objections that accompanied it. I propose an alternative to him is "thought idiosyncratic", with a statement of its purpose and usefulness, with reference to models of workbooks in this subject , And for the purpose of the title , i put an appropriate syllabus for this theme, and a related works in "idiosyncratic thought" to be from the Courses of colleges and institutes of sharia.
