الملخص
لقد حاولت هذه الدراسة عرض جانب من التراث الفقهي الذي خلفته المدرسة الفقهية الجزائرية الرائدة في المزاوجة بين العقل والنقل، والربط بين الرواية والدراية، وراعت الى حدود بعيده أوضاع الناس واعرفهم على نحو يرفع الحرج ويزيل المشقة. من الموروث الفكري والثقافي والعلمي للمجتمع الجزائري موضوع النوازل والفتاوى الذي يعتبر من بين أهم المواضيع التي ينبغي الاهتمام بها لقيمتها العلمية، لأنها تبرز أساليب الفقهاء في الاجتهاد وطرق تنزيل النص على الواقع. والإمام سعيد بن محمد العقباني نموذج من علماء المدرسة المالكية البارزين الذين ظلت وستظل أثاره العلمية شاهدة على تضلعه ورسوخ قدمه وإحاطته بمذهب الإمام مالك أصوله وفروعه. Abstract : This study has attempted to present a side of the jurisprudential heritage left by the Algerian school of jurisprudence, which was the pioneer in ccombining between reason and transmission. This school has taken into account the conditions and customs of people to mitigate difficulties and remove hardship facing them. The issue of novelties ( latest developments) and fatwas in the intellectual, cultural and scientific heritage of Algerian society is among the most important topics that should be taken care of for its scientific value and for highlighting the methods of jurists in ijtihad and methods of projecting the text on reality. Imam Saeed ibn Mohamed Al-Aqbani is a model of the prominent scholars of the Maliki School whose scientific studies was and will remain as a witness of his great abilities in the origins and branches of the Imam Malik doctrine. .
