أثر السياق في الفهم المقاصدي للنص الشرعي

الملخص
أولى العلماء أهمية للسياق وراعوا في ذلك ضوابط حتى يسلموا من الوقوع في الزّلل عند تفسيرهم للقرآن الكريم وشرحهم لأحاديث النبي صلى الله عليه وسلم؛ وللتوسّع أكثر في هذا الموضوع، جاءت هذه الدراسة لتعالج الاشكالية التالية: ما المقصود بالسّياق، وما هي عناصره، وفيما تكمن أهميته وكيف يحقق الفهم المقاصدي للنّص الشرعي. وبناء عليه، انتظم البحث في أربعة مباحث: خصّص الأول لتعريف السياق والفهم المقاصدي، وخصّ المبحث الثاني عناصر الخطاب وأهميتها في كشف دلالة النص الشّرعي، و بيّن في الرابع علاقة السياق بالفهم المقاصدي للنص الشرعي، وقدم في المبحث الرابع نماذج اعتبار السياق عند المفسرين والأصوليين والمحدّثين والفقهاء. Scholars gave importance to context and took into account controls so that they would be safe from making mistakes when interpreting the Holy Qur’an and explaining the hadiths of the Prophet, peace be upon him . To expand further on this topic, this study came to address the following problem: what is meant by context, what are its elements, what lies its importance, and how to achieve the intended understanding of the legitimate text. Accordingly, the research was organized into four sections: the first was devoted to defining the context and the Makassed understanding. The second section highlighted the elements of discourse and their importance in revealing the significance of the legitimate text, and in the fourth he explained the relationship of context to the Makassed understanding of the legitimate text, and in the fourth section he presented models for considering context among interpreters, fundamentalists, hadith scholars, and jurists.
