الملخص

تناولت هذه الدراسة تأجير الذهب والفضة للزينة والحلي إجارة منتهية بالتمليك في الفقه الإسلامي، هادفة إلى التعرف على ماهية عقد إجارة الذهب والفضة للزينة والحلي مع ارتباط هذا العقد بالوعد بالتمليك، حيث تم الوقوف على حقيقة الإجارة المنتهية وصورها وكذلك التكييف الفقهي لها في التشريع الإسلامي، وعالج البحث رأي الفقهاء في إجارة الذهب والفضة للحلي وغيره وظهر فيه أن الراجح لديهم هو مشروعية ذلك عملًا بالأصل العام في حكم عقد الإجارة، وبناء على جواز عقد الإجارة المنتهية بالتمليك في الصور المذكورة في البحث فقد تبين كذلك جواز إجارة الذهب والفضة للحلي إجارة منتهية بالتمليك وفق تفصيلات وضوابط وشروط وردت في هذا البحث. Abstract: This study has dealt with Renting Gold and Silver for Decoration and Ornaments for the sake of Ownership in Islamic Jurisprudence. It aims at identifying what a gold and silver lease contract for decoration and jewelry is when this contract is being linked to the promise of ownership. Therefore, the nature of the expired lease and its forms as well as the doctrinal adaptation of it in Islamic legislation has been clarified. Thus, the research has already dealt with the jurists’ opinions on the rental of gold and silver for decoration, ornament and other purposes. It appears that the most of the jurists legitimize that act according to the general principle of the ruling on the lease contract. Based on the permissibility of the lease contract ending in ownership in the cases referred to in this paper, it has been found that it is permissible to lend gold and silver for decoration and ornament, and the rental contact might be leased for ownership according to some details and terms listed in the research.
